Our DCFS Case is Closed!

Nearly two months after our incident at the emergency room where we were turned into DCFS by an angry nurse, DCFS finally stopped by and closed our case.

According to the caseworker I was turned in because I did not immediately give R a dose of oral steroids which they thought he needed for a diaper rash.  The rash was not related to the reason for the ER visit.

A nurse dropped an oral syringe of steriods off asking that I administer them myself when he was done nursing.  He nursed and fell asleep.  During that time I decided oral steroids was a bit of overkill for a slight diaper rash and asked to speak with the doctor about getting a topical cream instead.  I did eventually talk to the doctor and he had no problem with that.  He suggested we use over the counter hydrocortisone.

I don't understand how asking to speak to the doctor results in turning me in for medical neglect.  If this is the true reason then any parent could be turned in simply for asking questions regarding their child's care.

I think it's pretty obvious that the reason given to DCFS was fabricated in order to get back at me personally.

What makes this case so dissapointing is that the hospital refused to give up the nurses' last names or license numbers so I cannot file a complaint with the state.  The hospital also refuses to respond to my formal complaint.  As far as I know they have taken no action at all.

What happened when you filed the complaint with the hospital? Suing for emotional distress might be the sort of thing that would get you that last name.

Nothing happened. The hospital would not even respond to my complaint or to the formal complaint DOC filed. As far as I know no action at all was taken. Apparently they don't care that their nurses are falsely reporting parents. I'm going to see if there is a medical record to gain the nurses' info so I can file a complaint with the state. Or perhaps I will call the state licencing board and ask them if they can contact the hospital to demand the information.

You are legally allowed to request a copy of all of his records from that night! Get it, might cost you so much per page but you are entitled to it. And like someone on your fb said, might have been a "temp" nurse they hired for the night.

I'm glad that it's finally over but I still have anxiety over it all! As a mandated reporter myself, I cannot believe that someone abused their power in such a way.

As for the medical record, it is absolutely your legal right to have a copy of any and all medical records. You are such a great mama to push forward to help both your children, and other children in the future.
